Supreme Court Allows Unlimited Self Funding in Campaigns

I had to write you all right away with breaking news about campaign finance law.  Today, the Supreme Court of Bush appointees ruled that the "Millionaire's Amendment" of the 2002 Bipartisan Campaign Reform Act is unconstitutional.

What does this mean for America's elections?  It means there is no protection for the average American against those who can afford to "buy" an election.

The Millionaire's Amendment was enacted by Congress to create a level playing field against a candidate who made the choice to self-fund his or her campaign.  In that case, the opponent was permitted to raise more money from supporters to give them a fair opportunity to compete.

Our Congressman Jerry McNerney is not a millionaire.  When choosing his career, he passed on a high-dollar job with an oil company to join the fledgling renewable energy industry.  His choice contributed to saving the equivalent of about 30 million barrels of oil, or 8.3 million tons of carbon dioxide - the main greenhouse gas - as well as other harmful pollutants.

Click Here To Helpchoice.  He went to Texas to interview with a company and as soon as he stepped off the plane he could smell and taste the oil and pollution from the nearby refinery, he thought, 'I can't do this, this is not the world I want my kids to grow up in.'

Jerry made it to Congress through hard work and broad-based grassroots support from over 16,000 individual contributors - with the overwhelming majority donating less than $50.

At the beginning of June, we launched a challenge to you - $50,000 by June 30th.  We have been awed by your response.  In just a few days, more than $30,000 in small donations has come in to meet that challenge, and we thank you.

Conservative court rulings like this put regular folks like Jerry at risk.  In my years working on campaigns, I have seen what can happen to good people who put everything they have at risk to run for office and serve their country when their wealthy opponent chooses to "exercise" their free speech by throwing their millions into the campaign.  Before I started working for Jerry, I heard a story about how he put everything on the line - even taking a second mortgage on his house - so he could run against corrupt Richard Pombo.

I hope you'll consider giving a donation to our campaign today.  We need $20,000 more to meet our June challenge - money we're using toward our grassroots field campaign to talk to voters one on one about the real issues affecting their lives.  We need regular folks, just like you, me, and Jerry, to take America in a new direction.

Update from the trail

This past weekend, we had over 60 McNerney supporters knocking on doors throughout the 11th Congressional District!  There were canvasses in Morgan Hill, Tracy, Stockton, and Dublin – all with volunteers walking up front steps to let local voters know what Congressman McNerney stands for and his upcoming reelection run this fall.

I had the pleasure of being teamed with Saifi Ranawala and his two sons, Hamza and Adil in Tracy. We walked all over his neighborhood off Schulte Road and had a lot of great conversations with Democrats, Independents, and Republicans alike.  The boys seemed to particularly love running ahead and ringing all the doorbells!

One conversation we had stands out in my mind in particular.  Saifi and I knocked on the door of a woman named Dolores.  She invited us inside to talk about Congressman McNerney and his campaign.  A registered Republican, she said she saw herself more as an Independent but was open minded to all candidates.  We talked about the Congressman’s plans to reduce traffic problems, expand renewable energy options, and fight for the rights of our veterans.  Dolores admitted she hadn’t known what to expect when she opened the door that morning but now counted herself a McNerney supporter and soon-to-be campaign volunteer!

All in all, what a great day.

Historic energy bill passed today

On Friday, I reached out to ask you and others like you for help. And hundreds responded. I'd like to personally thank all of you for your help now and for everything you have done over the past months and years.

As we approach the end of the year, and the important fundraising deadline, I turn to you once again. I'll be frank: I need you to give what you can. Donations of $15, $20, $40, or any amount come together and give us the strength and resources necessary to continue our fight for change.

I am back in Washington for the week, working hard for a better national energy policy. I am proud to report that just this afternoon we passed an energy package that includes an increase of vehicle fuel efficiency standards - for the first time in 32 years! The bill also makes other solid investments in our energy independence, including my bill to increase research and development funding for 21st century geothermal energy technology.

While not perfect, and unfortunately without a renewable electricity standard and production tax credits, this bill is an important step, one of many such steps we must take to address climate change and move our country in a new direction. I can't wait to come back after the holidays to continue the fight.

The words were like gold to Jerry McNerney, the Democratic congressman-elect from Pleasanton who beat a powerful GOP incumbent and is back in his district briefly before he takes the oath of office.

"I'm not old enough to vote for you,'' Ryan Rubin, a 17-year-old Foothill High School student, told McNerney at a fundraiser Friday night in Pleasanton, "but I'll be old enough to vote for you in two years."

McNerney, who won by six percentage points, wants to hold on to his margin. But Rubin's remarks, made in a short receiving-line conversation, also served as a reminder of the pressure he'll face as a U.S. representative.

Election comes around every two years, and right after you win one, you have to start running again. There already are stirrings of Republicans, whose party holds a voter registration advantage in the district, gearing up to take on McNerney in the next round...

DUBLIN — Incoming Rep. Jerry McNerney hasn't even taken his seat on the House Transportation and Infrastructure Committee and he's already thinking big.

At a groundbreaking at Dublin City Hall on Friday for a $9 million traffic management project for the Tri-Valley, McNerney said he hoped to secure federal money for a BART extension down the middle of Interstate 580 — all the way to Tracy.

"BART to Livermore and Tracy — these are things that I'm very interested in," said McNerney, a Democrat who Nov. 7 wrested the 11th Congressional District from Rep. Richard Pombo, R-Tracy. As a member of the committee, McNerney added, "I will have the opportunity to bring projects to our area."

McNerney, whose new district comprises much of San Joaquin County and includes the Interstate 680 corridor in Alameda County and part of Contra Costa County, said improving links such as I-580 and BART "fits into my plan to bring economic development to San Joaquin County."...

Where's your polling place? What about absentee ballots? Voting problems?

The final day is upon us. Jerry will be going to the polls at 9 a.m. to vote at Donlon Elementary School in Pleasanton.

As you go to the polls and cast your ballots for Jerry, there is one more thing you can do. You can be our extended eyes for the election in making sure that your vote, and every vote, cast for Jerry is counted for Jerry.

Everything we've all worked for is now on the line. As Michael Fitzgerald reported in the Stockton Record today:

"Pombo and Jerry McNerney has become a hotly contested extravaganza of national importance. . . Bill Clinton touched down at Stockton's airport to rally for McNerney. Laura Bush is coming; Ben Affleck is coming; a tsunami of campaign ads is hitting. . . (in what) has become a key battlefield for control of Congress."    

Under white-hot heat from all sides, Richard Pombo is unleashing a new wave of personal attacks on me at the last minute to depress voter turnout. Pombo has raised $3.8 million -- almost twice as much as our campaign -- and he's spending it at the last minute to paint a distorted, ugly picture of me in the minds of voters.

President Clinton to 1,000 McNerney supporters: "The sun will be shining on Tuesday!" (w/ photos)

By all press accounts, President Bill Clinton hit a grand slam at last night's endorsement rally for Jerry McNerney, giving McNerney supporters a thrilling kick-off to our Get Out The Vote (GOTV) push over the final five days of the campaign.

Organized and promoted on extremely short notice, the 9 p.m. rally drew an astounding 1,725 pre-registrations via our web site only 12 hours after the original email invitation was released Wednesday morning.

Although November's first rainstorm dampened the final turnout to an estimated 1,000 McNerney supporters, the rain didn't dampen their spirits, as Hank Shaw reported in the Stockton Record:

Nearly 1,000 people waited in a drizzle that became a downpour to see Clinton cheer them on to help McNerney unseat the seven-term incumbent.

They used umbrellas. They used McNerney's signs - even cardboard boxes and plastic sheeting - anything to keep dry.

But none seemed to mind. They could feel victory within their grasp.

"I waited for two hours, and I don't mind waiting two more hours," said Joseph Garcia of Manteca.

"I just want to see Bill, and I want to see Jerry win."

The former president, who remains wildly popular with Democrats, whipped the soggy crowd on the tarmac into a froth, even though he was 90 minutes late for his 9 p.m. scheduled arrival.

"Thank you for waiting," Clinton said to the roaring crowd. "It may be raining tonight, but the sun will be shining on Tuesday."

According to Laura Kurtzman of the Associated Press:   

Clinton said late Wednesday night that voters should send Jerry McNerney to Congress because, as a wind engineer, he understands the technological innovations that could create a new wave of good jobs in alternative energy.

"We ought to have one person in the House who actually knows about it, who actually knows how to do it," Clinton said.

Lisa Vorderbrueggen's article in the Contra Costa Times highlighted Clinton's call to elect Jerry's "new energy" to Congress:

Clinton, wearing a dark suit jacket, blue shirt and red tie topped by his trademark shock of white hair, said it was time to elect an energy expert to Congress who will help wean the nation off its oil addiction.

McNerney, who has a doctoral degree in mathematics, has been a wind energy consultant.

"The thing I like best about sending Jerry McNerney to Congress is that he has the expertise to help us build a clean energy economy," Clinton said.

New poll released; Pombo's troubles mount as Republicans move to McNerney

As a result of the latest independent poll showing Jerry McNerney leading Richard Pombo 48-to-46  percent (Constituent Dynamics, conducted Oct. 24-26), the San Jose Mercury News reports that the "GOP has launched a rescue mission in the final weeks of the campaign to save" Richard Pombo.

No matter how much money the Washington wing of the party throws at Pombo, the grounded reality is that Republican voters in the district are deserting Pombo in droves. How else to explain the polling in a district with party registration that significantly favors a Republican incumbent?

As the Mercury News reports, the exodus from Pombo is real:

But Pombo is in trouble for other reasons as well. While much of the district is still rural, more retirees and suburbanites have moved in -- even to Tracy, Pombo's home.

Real estate office worker Alice English said she usually voted Democratic but the big change this year was her husband, a Republican, would not vote for Pombo "because of all the negative ads they're putting out.''

"We used to cancel each other's votes," she joked. "Not this year."

We've heard the same thing from many voters -- and Republicans specifically -- who are sick and tired of Richard Pombo's relentless and misleading attacks on Jerry McNerney. They keep asking a simple question: why won't Pombo run his campaign based on what he's actually done for voters in the district over the last 14 years?

Of course, the answer is obvious: Pombo's record is paltry, especially given that he is Chair of the House Resources Committee. So, instead of running on a positive campaign based on legislative accomplishments, Pombo spends his time avoiding the media while spending millions of dollars running distorted fear-and-smear attack ads against Jerry McNerney.

Meanwhile, Jerry McNerney is running on issues and talking about what he'll do once elected to Congress. One of Jerry's first priorities? Stem cell research. Click here for clips from Jerry's press conference on stem cell research earlier this week.

Bill Evans, 70, a retired Air Force bomber pilot who moved to Pleasanton four years ago, opposes the Iraq war and has helped organize veterans for McNerney, whom he calls "a straightforward man of integrity."

Maybe most telling was the reaction of Debbie Bennett, a Republican retiree from Danville. She voted for Bush twice but said she is "very disappointed in the war,'' and might sit out this election.

Whether they are supporting Jerry McNerney or staying home in protest, Republicans from Manteca to Morgan Hill are deciding that it's time for a change. Enough is enough.

McNerney outraises "desperate" Pombo

According to fundraising reports filed just released by the Federal Election Commission, Jerry McNerney outraised Richard Pombo during the first 18 days of October. McNerney collected more than $416,000, boosting his election cycle total to nearly $1.6 million. Pombo raised about $343,000 for the period, more than $50,000 less than he had purportedly received from an early October fundraiser with President Bush alone.

"Jerry McNerney is proud that small, individual contributions have helped his people-powered campaign outraise Richard Pombo's lobbyists and President Bush's friends," said McNerney communications director Yoni Cohen.

"The latest fundraising reports and campaign emails show that Pombo desperately needs more of George Bush's help. Jerry McNerney hopes the President returns to California and reminds voters that both Bush and Pombo are satisfied with the lack of ethics and integrity in Congress, and with the directions in which America and Iraq are headed."

Senator Dianne Feinstein endorses Jerry McNerney for Congress

United States Senator Dianne Feinstein today endorsed Jerry McNerney and praised his campaign for change. In her 2000 Senate run against former Republican Rep. Tom Campbell, Feinstein won Alameda, Contra Costa, San Joaquin, and Santa Clara counties by overwhelming margins.

Pombo: "I will continue to oppose stem cell research"

Jerry McNerney held a press conference yesterday, expressing his support for embryonic stem cell research.

Lisa Vorderbrueggen covered it in the Contra Costa Times:

... Flanked by a renowned stem cell research advocate, a San Ramon Valley pediatrician and a Danville mother of a 4-year-old daughter with cystic fibrosis, McNerney called embryonic stem cell research an integral component of his health care reform platform.

"Health care is a very important issue to me, and stem cell research is one part of that," said McNerney during a news conference held on the perimeter of a children's playground in San Ramon. "We need to move forward with stem cell research. Our country needs to support it as a tool for our health system."

Pombo has consistently sided with President Bush, who opposes the destruction of human embryos for stem cell research.

The congressman was among 180 Republicans who opposed a bill this past spring that would have expanded federal funding of embryonic stem cell research. Defying a threatened presidential veto, Congress passed the legislation. Pombo voted against the motion to override the president's veto.

But Pombo said he voted the same day for federal funding of research on adult stem cells and previously approved embryonic stem cell lines.

"A fertile embryo is human life and I have consistently opposed destroying human embryos for research and I will continue to oppose it," Pombo said.

Vorderbrueggen reports that this is an issue that touches everyone, regardless of party registration:

Unlike other hot-button issues that divide conservatives and liberals, many Republicans support embryonic stem cell research, including Nancy Reagan, wife of the late President Reagan.

The voters in Pombo's district have supported it, too.

Proposition 71, a $3 billion statewide bond in 2004 to fund stem cell research, passed in District 11 with a 10 percentage point margin -- 55.5 percent to 45.5 percent -- although by a narrower margin than the rest of the state. District 11 stretches from Morgan Hill to Danville and encompasses most of San Joaquin County.

Pam Nett of Danville, who describes herself as "pro-life," said embryonic stem cell research could hold the secrets of a cure for cystic fibrosis, the debilitating disease that afflicts her daughter, Jessica. Stem cell replacement therapy, she said, could help repair Jessica's damaged lung tissue and DNA analysis could help lead to a cure for cystic fibrosis.

The actions of Bush and Congress to limit the funding "crushed me," Nett said. "A cure is 10 years down the road because it takes so long already. I'm pro-life, and I believe stem cell research will save the lives of millions of people."

Colleen Hogan, a pediatrician with the San Ramon Valley Primary Care Medical Group, and stem cell advocate Don Reed emphasized the need for the United States to tap into the thousands of embryos stored in fertilization clinics that will be destroyed.

Reed, who formed Californians for Cures after his son was paralyzed in a football accident in 1994, urged voters to select McNerney as the district's next congressman.

"I don't need Richard Pombo to make my family's medical decisions," he said.

Editor -- Richard Pombo's letter states "I never suggested, proposed, voted for, or endorsed" the selling off of national parks. At the Oct. 5 debate in Tracy, he told the audience "I floated the idea to see what interest there was."

Thursday night at a forum in Dublin, he took the middle ground and asserted "It was a proposal some of the staffers worked on, not something I did." The "truth" to Mr. Pombo seems to be set in a geopolitical context: The more left (San Francisco) we are, the more he distances himself from his message to his core constituency. To continue the recent crossover trend, I, a Danville Republican, will not vote for Richard Pombo.

San Jose Mercury News Editorial: Pombo "Deserves Defeat"

In a powerful condemnation of California's two congressional "culture of corruption" poster boys, the San Jose Mercury News published an editorial today excoriating the egregious activities of Richard Pombo and John Doolittle and applauding voters for potentially "throwing them out" on Election Day.

Even gerrymandering can't guarantee the re-election of California Republican Congressmen Richard Pombo and John Doolittle. Many voters have had it with their money-grubbing and their party's influence-peddling. It's about time.

Where did Pombo and Doolittle learn to ply their trade? Under the shady hand of maestro Tom "The Hammer" DeLay, the man who single-handedly vaulted Pombo to the chairmanship of the House Resources Committee despite a lack of seniority and experience (many Republican members of the House are as equally troubled by Pombo's activities as Democrats).

Doolittle and Pombo rose to leadership positions under (Tom) DeLay and have been enmeshed in the web of corporate lobbyist ties that he established.

Five years ago, Doolittle and Pombo interfered with an investigation by the Federal Deposit Insurance Corp. into a failed savings and loan owned by Texas businessman Charles Hurwitz, a major GOP donor. In what an FDIC spokesman called ``a seamy abuse of the legislative process,'' Doolittle and Pombo introduced sensitive documents into the Congressional Record to damage the government's case.

In a practice that Congress should ban, Pombo encourages industries that lobby his committee to pay staff junkets to places like Atlantic City. Those expenses totaled $197,000 between 2003 and 2005. More than 40 businesses and trade groups hosted a grand "Pombo Palooza" at the 2004 national GOP Convention.

"Pombo Palooza"? Somehow one can't imagine Jerry McNerney, a man of honesty and integrity, ever signing on to participate in a "Jerry Palooza" paid for by industry lobbyists.

That's the difference between Pombo and McNerney. Pombo revels in his rampant corruption, acting incredulous when congressional watchdogs call him out, while Jerry spends his time mobilizing the support of hard-working citizens with a deep commitment to cleaning House in 2006. First stop on the Campaign for Change tour? Removing the Chair of the House Resources Committee.

Pombo chairs the House Resources Committee, which regulates Indian affairs. He received $7,500 in campaign donations from Abramoff, who has pleaded guilty to defrauding an Indian tribe he represented, and $30,000 from clients of Abramoff. Although Pombo has consistently denied being lobbied by Abramoff, the Associated Press reported this week that in the mid-'90s, Abramoff twice billed clients for discussions he had with Pombo.

Both Doolittle and Pombo also put relatives on campaign payrolls -- a practice that, while not illegal, should be discouraged. Pombo's brother Randall, his campaign's treasurer, has received an average of $43,000 a year since 1992. His wife, Annette, has been listed as a consultant since 2003, earning an average $48,000 a year...

Doolittle and Pombo embody Washington's incestuous political culture. By throwing them out, voters would signal the need for change.

No matter how many ridiculous hit pieces Richard Pombo and the NRCC release to attack Jerry and depress voter turnout, Pombo is still fighting a massive uphill battle in the realm of public opinion. The evidence is building that Pombo is no longer fit to serve in Congress. Between now and November 7, Jerry plans to demonstrate to voters that he is -- as Jerry says so often -- the right man for the job at the right time.

It's time for a new direction.

BREAKING: Abramoff Lobbied Pombo, Records Show

Erica Werner, of the Associated Press, has just dropped a major bombshell on the 11th Congressional District. Despite Pombo's denials, there are records showing several lobbying contacts with Jack Abramoff.

Remember just last Thursday evening at the Tracy Forum when Richard Pombo was questioned about his connections to Jack Abramoff? According to Erica Werner of the AP, Pombo strongly denied ever being involved with Abramoff:

"I met the guy two or three times in my whole life — he never once lobbied me on anything," Pombo said of Abramoff last week in a debate against McNerney.

Really? The AP story exposes a different version of the story:

Records show the disgraced lobbyist [Abramoff] billed a client for at least two contacts with Pombo a decade ago.

The lobbying records released by the Northern Mariana Islands show that Abramoff billed once for calls to Pombo, chairman of the House Resources Committee, and a second time for a discussion with him, while lobbying in 1996.

On more than two dozen other occasions from 1996 through 2001, Abramoff associates called or met with members of Pombo's staff, including his chief of staff, the records indicate. As the contacts picked up, Pombo voted Abramoff's way on a bill important to Abramoff's clients.

Here are the particulars of the Pombo/Abramoff deal:

One focus was legislation in the Resources Committee, of which Pombo was then a junior member, to give the Marianas a nonvoting delegate to Congress. Then-Marianas Gov. Froilan Tenorio was opposed. Abramoff and his associates lobbied the Hill, including a July 29, 1996, contact with Pombo's office.

Three days later the bill was narrowly defeated in committee. Pombo voted no.

"I have great news!" Abramoff wrote to Tenorio on Aug. 1, 1996. The delegate bill "was DEFEATED at the markup which finished about an hour ago. ... We were able to add four conservative Republicans to the block of Democrat opponents and defeat the bill by a vote of 13-12." […]

On Sept. 10, 1996, Abramoff billed for a discussion with Pombo. Two days later he gave Pombo a $500 donation, the first of what would become $7,500 in campaign contributions. Pombo has since donated the money to charity. On Nov. 21, 1996, Abramoff reported putting in calls to Pombo and other lawmakers.

And what do you imagine Pombo’s response is? Pombo spokesman Brian Kennedy disputed the reported contacts, saying direct lobbying by Abramoff "never happened" and the staff-level contacts were "greatly inflated." Abramoff, who pleaded guilty in a congressional corruption investigation, is "an admitted felon" who can't be trusted, Kennedy said.

Richard Pombo's days are numbered. Maybe that's why he's going for broke. In what Stockton Record reporter Hank Shaw described as potentially the "most desperate campaign move I've seen in years," Pombo is giving voters his home phone number (if you call, please be civil and polite).

After today's AP exclusive on Pombo and Abramoff, the phone is going to be ringing off the hook, no doubt.

Encouraging words in a San Ramon precinct: A 50-ish guy answers the door, takes one look at my Jerry McNerney for Congress t-shirt and before I can say anything he says:

"Is that the guy running against Pombo? Well, he's got my vote.  That guy, Pombo, is such a crook!  And I'm a Republican!"

We're hearing from a lot of Republicans these days who are in full revolt against Richard Pombo and want to put an end to the culture of corruption in Washington. Pombo, as many of you know, was named one of the 13 most corrupt members of Congress by the non-partisan Citizens for Ethics and Responsibility in Washington.

Congresswoman Jane Harman joins Jerry in Stockton Monday

Jerry McNerney will be joined by Congresswoman Jane Harman (CA-36) at the University of the Pacific (Bechtel International Center) on Monday, October 9, at noon for a talk on issues of National Security.

Congresswoman Harman is currently the ranking member of the House Permanent Select Committee on Intelligence. Jerry McNerney, a renewable energy expert, is slightly ahead of Richard Pombo, 48-to-46 percent, according to poll released last week by Greenberg Quinlan Rosner Research.

Pombo, Running Scared, Refuses to Release Polls

On Monday, after Greenberg Quinlan Rosner Research released a respected poll showing Jerry McNerney leading Richard Pombo 48 to 46 percent, Pombo's campaign manager starting spinning like a top.

"They must be polling on Fantasy Island," Fogliani said. "We never release our polls, but that's way off. McNerney never gets out of the 30 (percent range) in our numbers."

Fogliani is paid to downplay bad news for his boss, of course. He's also paid to keep bad news from the press. Perhaps that's why Fogliani and Pombo refuse to release their polling numbers on this race.

As Daily Kos blogger Markos Moulitsas wrote yesterday in response to Fogliani's spin:

"You don't call in the big guns like Bush, you don't spend half a million in spread-thin NRCC funds, and you don't hide your polls unless you're in serious trouble. And Pombo (is) in trouble."

Make no mistake about it. Despite drawing $400,000 from George W. Bush's ATM on Tuesday, Pombo has a ceiling in the polls, due to daunting disapproval numbers. Pombo knows that the only way he can win is to depress turnout with a blizzard of ridiculously negative advertising against Jerry.

Just yesterday, the National Republican Congressional Committee dropped $30,000 more on this race, purchasing yet another poll and more misleading direct mail hit pieces on Jerry. According to a Congressional Quarterly piece published yesterday in the New York Times:

The National Republican Congressional Committee has, according to Federal Election Commission reports, paid for two internal polls in the district to gauge voter preferences in the 11th District, but the committee has not released any results.

Democrats, on the other hand, have not hesitated to publicize two “own” polls that purport to show a tossup race. A survey conducted by the Democratic firm of Greenberg Quinlan Rosner showed McNerney actually leading by 48 percent to 46 percent. A poll by Lake Research, another Democratic firm, showed Pombo with a statistically insignificant lead of 41 percent to 40 percent.

We released our internal poll (via Lake Research) even though it showed Jerry losing by a point. So why hasn't Pombo or the NRCC stepped up to the plate, if their polls actually demonstrate better results?

Perhaps we'll have to wait for the most important public poll of the race -- Election Day. Until then, brace yourself for the next 32 days of attacks. And think about how you can help us overcome Pombo's millions.
